Principle of the development The proposed two storey side and the rear dormer window are not considered to be acceptable given the overall bulk and design. The proposed two storey side extension is of a width, height and incorporates an insufficient set back from the front building line, results in an unduly dominant addition in relation to the host property, and its setting with the adjoining semi-detached property, resulting in detrimental impact on the the visual amenity of the streetscene. It is also noted that the adjoining property no. 35 Courtland Avenue, has not benefitted of a hip to gable roof extension or a side extension and as a result the proposed two storey extension and gable end to no. 37, is considered to have an unbalancing effect detrimental to the character of the pair of semi-detached properties and wider area. A large rear dormer is proposed that would occupy the whole original roof plan and would also extend behind the new gabled end roof to the proposed two storey side extension, whereby it would be out of keeping with host property resulting in a visually dominant and top-heavy addition on the roof. A full width single storey rear extension is proposed, which would run along the original dwelling house and proposed two storey extension. The design of the proposal would complement the appearance of the main building in terms of proportion and materials. The extension is subordinate to the original house and would comply with the Residential Extensions and Alterations SPD. It is therefore considered that the proposal would not materially harm the character and appearance of the existing building, the street scene and the wider locality. B. Amenity of Neighbouring Occupiers The proposed two storey side extension and dormer window would not directly impact on the amenity of the neighbouring properties in terms of overlook, loss of light and overshadow. The proposed single storey rear extension would have a depth of 3.1 metres and would be in line with the existing rear extension to the neighbouring property no. 35 Courtland Avenue and would be 1 metre away from the side boundary with no. 39 Courtland Avenue; given the proportions and the relationship between the proposed rear extension and the neighbouring properties, it is not considered that it would be detrimental to the amenities of the occupants of any neighbouring property. 12-05-2011

357 Hoe Street, Walthamstow, London, E17 9AP London Borough of Waltham Forest 14-01-2021 1) It appears to the Council that the breaches of planning control referred to above in section 3 has occurred within the last 4 years. 2) The unauthorised installation of a retractable roof and single storey timber framed rear extension encompasses the whole of the rear area and appears a prominent and dominant appendage to the host property. The rear extension is covered by a retractable roof with metal framed supports. The side panels of the structure are also retractable within the frame of the extension. The lightweight materials used to construct the full-size framed extension and the side panels create a crude bolted on appearance, which is significantly at odds with the character of the host building as a traditional terraced property. The overall scale and design of the development represents a poor-quality and a highly incongruous addition. Such development is out of keeping with the garden setting of the property and the terrace as a whole. The development is therefore contrary to policies DM1 “Sustainable Development and Mixed-Use Development” and DM29: “Design Principles, Standards and Local Distinctiveness” of the Waltham Forest Local Plan (Adopted October 2013), and policies CS14: “Attractive and Vibrant Town Centres” and CS15: “Well Designed Buildings, Places and Spaces” of the Waltham Forest Core Strategy (Adopted March 2012) along with policies 7.4 “Local character” and 7.6 “Architecture” of the London Plan (Adopted March 2016); Policy D4 “Delivering good design” of the Draft London Plan (2019); as well as Section 12 “Achieving Well-Designed Places,” of the NPPF (February 2019). 3) The unauthorised installation of a retractable roof and single storey timber framed rear extension provides a substandard form of development which is not appropriately sound proofed for a dense residential area. The intensified use of this rear area has resulted in an unacceptable level of noise associated with the use which is to the detriment of local residential amenity. The development contravenes policies, DM1: “Sustainable Development and Mixed-Use Development,” DM25: “Managing Town Centre Uses,” DM27: “Night Time Economy Uses,” DM32: “Managing Impact of Development on Occupiers and Neighbours,” of the Waltham 3 Forest Local Plan Development Management Policies (October 2013); Policies CS1: “Location and Management of Growth,” CS13: “Promoting Health and Wellbeing” CS16: “Making Waltham Forest Safer” of the Waltham Forest Core Strategy (March 2012), along with Policy 7.2: “An inclusive environment,” Policy 7.15: “Reducing and managing noise, improving and enhancing the acoustic environment and promoting appropriate soundscapes,” of the London Plan 2016, as well as Section 2 “Achieving sustainable development,” and Section 9 “Promoting healthy and safe communities” of the NPPF (February 2019). 4) To conclude, the Council consider it expedient to issue an enforcement notice as there are no lesser steps which can be taken to remedy the breach of planning control outlined in this notice.  24-02-2021
